If a user does not have the permission mod/facetoface:signupwaitlist enabled in Totara 11 then a user will be booked into the seminar even if the capacity has been reached rather than being put onto a waitlist.
If you want the ability to add users to a waitlist than you will need to enable this permission for a role and switch to this role or login as a user in this role. The user will then be able to be added to the waitlist rather than being overbooked.

Hi Andrei
If a user who is wanting to signup to an event they won't be able to if the maximum users have been reached.
If they are being added by someone else then they will be able to add the attendee and overbook the learner. I can't think of a way around this.

I couldn't replicate this in 11 & 13 by
1) Actually logging in as test users and trying to overbook.
2) As admin logging in as the users and trying to overbook.
Could you open a support ticket and provide a numbered step through and screenshots?
Can you check the roles of the test users?
